Hello all.


I have been asked by a friend to try to find out if anyone on the forum has experience with Chinese law and whether a foreign employee is entitled to any form of redundancy package should his work contract be terminated before the expected end date.


He has been working in Wuhan China for a Chinese company for six years and was expecting to continue for another six months. Unfortunately the company he works for no longer needs his services and according to the contract either party can terminate the agreement with one months notice. But he has heard that under Chinese law the company must still abide by local regulations / law and pay a redundancy package based on his years of service but he does not have any details.


He stresses that he is not trying to screw the company but only wants to be treated fairly and according to Chinese law. Perhaps someone has some knowledge of this or knows of someone to contact that specialises in this kind of thing.

Redundancy must be done in accordance with certain procedures and there will be a servarance pay calculated based on your friend's service year with the company.
